Agreement to these terms
By accessing or using this website you agree to these Terms of Service and to our Privacy Policy. If you do not agree, please do not use the site. If you use it on behalf of a company, you confirm that you have authority to bind that company.
About CodeScapes and this site
CodeScapes is a software engineering consultancy. This website describes our services and how to contact us. It is provided for business use by people who are at least 18 years old.
Services and engagements
Nothing on this site is an offer that binds us, and descriptions of services, timelines and outcomes are general. Specific work is defined in a statement of work or master services agreement signed by both parties.
If these terms conflict with a signed client agreement, the client agreement prevails for that engagement.
Acceptable use
You may use the site to learn about CodeScapes and to contact us. You agree not to:
- Break the law or infringe anyone’s rights.
- Attempt to gain unauthorized access to the site, its servers or other users’ data.
- Probe, scan or test the site’s security, except as set out in “Security research” below.
- Interfere with the site’s operation, including by overloading it or scraping it at a volume that degrades service.
- Introduce malware or any code intended to damage or disrupt systems.
- Submit false, misleading, abusive or unlawful content, or impersonate another person.
- Use the site to build a competing service or to send us unsolicited promotions.
Your submissions
Information you send through the contact form or by email remains yours. You give us permission to use it to respond to you and to evaluate your request, as described in our Privacy Policy.
Please do not send confidential, sensitive or regulated information before we have an agreement in place. Until then, we cannot treat what you send as confidential.
Intellectual property
The site, including its design, text, graphics, code, logos and the CodeScapes name, is owned by CodeScapes or its licensors and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable licence to view the site and to share or print pages for personal or internal business use.
You may not copy, modify, distribute or create derivative works from the site except as this licence allows. Deliverables created for clients are owned as set out in the client agreement. Open-source projects we publish are licensed under their own licences.
If you send us suggestions or feedback, we may use them freely without obligation to you.
Privacy and data protection
How we handle personal information is described in our Privacy Policy. How we handle client data during an engagement is described on our Data security page and in the client agreement.
Security research
We welcome good-faith reports of vulnerabilities. If you find one, send details to us as described on our Data security page. While testing, please avoid accessing other people’s data, degrading the service or exposing what you find, and give us a reasonable time to fix the issue before disclosing it. We will not pursue legal action against research that follows these guidelines. Other probing or testing of the site requires our written permission.
Third-party links and services
The site may link to other websites or rely on third-party services. We do not control them and are not responsible for their content, availability or practices. Using them is at your own risk and subject to their own terms.
Availability and changes to the site
We aim to keep the site available, but we do not guarantee uninterrupted or error-free access. We may change, suspend or discontinue any part of the site at any time, and we may carry out maintenance without notice.
Disclaimer of warranties
The site and its content are provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including accuracy, completeness, merchantability, fitness for a particular purpose and non-infringement. Content on the site is general information, not professional advice for your situation.
Limitation of liability
To the fullest extent permitted by law, CodeScapes and its directors, employees and contractors are not liable for indirect, incidental, special or consequential damages, or for lost profits, revenue, data or goodwill, arising from your use of the site. Our total liability for any claim relating to the site is limited to USD 100.
Nothing in these terms limits liability that cannot be limited by law, including liability for fraud or for death or personal injury caused by negligence.
Indemnity
You agree to indemnify and hold us harmless from claims, losses and reasonable costs arising from your misuse of the site, your submissions, or your breach of these terms.
Suspension and termination
We may suspend or restrict your access to the site at any time, with or without notice, if we believe you have breached these terms or put the site or other users at risk. Sections that by their nature should survive — including intellectual property, disclaimers, liability and governing law — will continue to apply.
Governing law and disputes
These terms are governed by the laws of India, without regard to conflict-of-law rules. Before starting formal proceedings, each party will try in good faith to resolve a dispute informally for at least 30 days after written notice. Failing that, the courts at the location of our registered office in India have exclusive jurisdiction, unless a signed client agreement says otherwise.
Export and sanctions
You confirm that you are not barred from receiving services under applicable sanctions or export-control laws, and that you will not use the site in breach of them.
General
- Entire agreement: these terms, with the Privacy Policy, are the whole agreement between us about the site.
- Severability: if a provision is unenforceable, the rest remains in effect.
- No waiver: not enforcing a right is not giving it up.
- Assignment: we may transfer our rights under these terms, for example in a merger or sale; you may not transfer yours without our consent.
- Electronic communications: you agree we may communicate with you by email and by notices on the site.
Changes to these terms
We may revise these terms from time to time. The date above shows the latest revision. For material changes, we will say so prominently on this page. Continuing to use the site after changes take effect means you accept them.
